land certificates is often a concern in the community, related to complicated bureaucracy, time and costs.
In fact, at the Land Office, taking care of land certificates can be subject to a tariff of zero rupiah or free, for certain groups of people.
The free rate for managing land certificates is classified as a type of non-tax state revenue (PNBP).
The free tariff applies to three land services, namely as follows:
- Measurement and mapping of land parcel boundaries
- Soil inspection by Committee A or land inspection by the Constation Officer.
- Land registration for the first time, namely the extension and renewal of land use rights (HGU), building rights (HGB), or term use rights.
However, community groups who meet the requirements to be able to enjoy free tariffs to process land certificates still have to submit applications.
This is stated in the Regulation of the Minister of ATR/Head of BPN No. 25 of 2016 Article 5, concerning Requirements and Procedures for Imposing PNBP Tariffs to Certain Parties.
In the Ministerial Regulation, the requirements for submitting an application for the imposition of a zero rupiah tariff on types of PNBP for certain parties are:
1. Poor people
If the monthly income is below the local district/city UMP.
Attach a certificate from the head of the local RT/RW and it is known by the lurah, village head, or other names
2. Communities in the Government Program in the Simple Housing Sector
Attach a membership statement from the ministry in charge of housing
3. Legal entities in the religious and social fields whose land is used for worship, Islamic boarding schools, orphanages, nursing homes, cultural heritage, pilgrimage sites/places, including their supports
Attach a photocopy of the articles of association by showing the originals, and a certificate from the agency administering government affairs in the religious and social fields.
4. Veterans, Retired Civil Servants, Retired TNI/Polri and Husbands/Wife/Widows/Widowers Veterans/Retired Civil Servants/Retired TNI/Retired Police
Attach a photocopy of the appointment by showing the original, and/or a photocopy of the marriage certificate or marriage certificate for husband/wife/widower/widower.
5. Government Agencies and Local Government
Aims to carry out its duties and functions and is not for profit
Attach a certificate from the head of the agency or appointed official.
6. Wakif (Parties who endow their property)
Attach a photocopy of the Waqf Pledge Deed.
7. Indigenous peoples
Attach the determination of its existence from the Regional Government.
8. Additional notes
If the community group cannot show the original evidence of the above provisions, it can be proven by a certificate from the competent authority.
After fulfilling the above requirements, the community can submit an application to the Head of the local Land Office by attaching these requirements.
